Exemptions

There are certain exemptions that may apply under the Freedom of Information Act, these may include:

  • Information that contains personal data on an individual – this is covered under the Data Protection Act 1998.
  • Information which is intended for future publication.
  • Information that is held in court records.
  • Information pertaining to criminal investigation or proceedings.
  • Information that would prejudice commercial interests of a person or public authority.

This list is not exhaustive. The Service will confirm in writing whether the information is held and if an exemption applies, and the reasons as to why the information request is refused.
